Miller County prosecutors are not seeking the death penalty for a teen accused of killing two and wounding a third in a shooting Aug. 28 at a house in Texarkana, Ark.
Justin Dalton Wilson, 18, appeared in court Nov. 5 before Circuit Judge Brent Haltom. Wilson’s attorney entered pleas of not guilty for Wilson to two counts of capital murder, a charge of attempted capital murder, a charge of aggravated assault and a charge of aggravated robbery. According to court records, the state announced that it is not seeking the death penalty at this time.
Wilson allegedly shot and killed 45-year-old Scott Wiegmann and 36-year-old Reginald Davis in a house in the 2400 block of E. 24th Street. One man struck by a bullet, Lajohnta Collier, 24, survived. Collier’s son was allegedly sleeping in a bedroom of the house during the incident.
Because prosecutors are not seeking the death penalty, Wilson faces life without the possibility of parole if found guilty of capital murder. Attempted capital murder is punishable by 10 to 40 years or life in prison. Aggravated robbery is punishable by 10 to 40 years or life in prison. Aggravated assault is punishable by up to six years in prison.
Court records show prosecutors are seeking to enhance Wilson’s punishment for using a firearm and for committing the offense in the presence of a child.
