Texarkana Man Accused Of Firing Gun Near Woman’s Head With Her Kids Home

TEXARKANA, Texas–A Texarkana man has been charged with deadly conduct, aggravated assault, unlawful restraint and two counts of endangering the welfare of a minor in connection with an alleged domestic violence incident in August.

Marquaves Quashawn Smith, 31, allegedly woke up his live-in girlfriend sometime during the night of Aug. 20, upset about something he found in her cell phone, according to a probable cause affidavit.

Smith allegedly pointed a pistol at the woman and said, “I swear on my son, Imma kill you,” the affidavit said.

Smith allegedly pistol whipped the woman and forced her into the bathroom of a residence in the 200 block of Arlington Street and told her to look in the mirror “and see how scared she was,” the affidavit said. Smith allegedly fired a round from the pistol that missed her head by just a few inches.

Smith allegedly forced the woman into the living room, where continued to threaten her life, the affidavit said. Smith allegedly used the woman’s cell phone to call a friend of the woman’s and told her she would never see the woman again.

Smith allegedly demanded that the woman give him money and began rifling through her purse. The woman attempted to run out the front door but Smith grabbed her and threw her to the ground before she could unlock it. The woman allegedly managed to grab the gun and attempted to unload it by firing into the ground.

At some point, the woman’s two daughters came into the living room where Smith was allegedly assaulting their mother.

One of the bullets reportedly struck Smith, who was seen at a local emergency room at about 4 a.m. that morning. When officers interviewed Smith at the hospital, he was reportedly “vague” about where he sustained the bullet wound.

Later that morning, police were called to another medical facility where the woman had gone for treatment of her injuries.

Smith was arrested on the charges Sept. 27, jail records show.

If convicted of aggravated assault with a deadly weapon, Smith faces two to 20 years in prison. If convicted of unlawful restraint or deadly conduct, Smith faces two to ten years on each count. If found guilty of child endangerment, Smith faces six months to two years in a state jail on each of two counts.

Smith is currently being held in the Bowie County jail with bail set at $400,000.

He is represented by the Bowie County Public Defender’s Office. The case has been assigned to 202nd District Judge John Tidwell.
