Speeding Trucker Caused Highway Worker’s Death, Lawsuit Says

TEXARKANA, Texas–A federal wrongful death lawsuit blames the driver of an 18-wheeler for causing the death of a man working on Interstate 30 last August while speeding through a construction zone.

The parents of Braden Paul Tucker, who was killed Aug. 7, 2025, are suing the driver, Enork Desilus, and the companies he was working for, Rollin R’ Trucking doing business as One Cargo and Freight United Inc. 

Tucker had moved a highway maintenance vehicle equipped with visual signals onto the eastbound shoulder of I-30 that should have served as a warning to motorists to “move over or slow down.”

When Desilus saw the warnings, he should have changed lanes or reduced his speed to at least 20 miles below the posted speed limit, the complaint said. Desilus was allegedly traveling at 65 miles per hour or faster, according to the lawsuit.

A different commercial truck traveling behind and in a lane to the right of Desilus captured the collision on video. 

“It shows that Enork Desilus was speeding in the inside lane, and pulling away and ahead of this trailing 18 -Wheeler as Enork Desilus approached the scene of Braden Paul Tucker’s death,” the lawsuit said.

A passenger car that was directly behind Desilus allegedly slowed down and moved right to a different lane after seeing the warning truck, the affidavit said.

“If Enork Desilus had taken like action as the passenger vehicle right behind him did, (move over and slow down), Braden Paul Tucker would be alive today,” the complaint said. “Defendants had actual subjective awareness of this dangerous situation due to the warning signs and warning vehicles on the roadway, that the actions defendant Enork Desilus undertook would cause great risk to workers on Interstate Highway 30, including Braden Paul Tucker.”

The complaint alleges negligence by Desilus and faults his employers for failing to adequately train him.

Tucker’s parents are represented by the Burgess Law Firm PLLC. Counsel information for the defendants was not available Thursday.
