A man who plead guilty to possession of child pornography last year has been arrested for the same offense a second time.
James Michael Cagle, 20, appeared with a Bowie County public defender Monday for a pre-indictment hearing before 202nd District Judge Leon Pesek Jr., Monday morning. Cagle’s cases include a pending motion to revoke a 10-year probation he received in August 2015 for child pornography possession and an April 29 arrest for possession of child pornography with the intent to distribute.
Cagle was arrested by Texarkana, Texas, police in October 2014 for his first child pornography offense. Cagle gave investigators permission to look through contacts and text messages on his cell phone while he was at the department to report a robbery. A detective reading through Cagle’s messages found a text conversation that included sexually graphic photos of prepubescent children. The contact associated with the text conversation was stored in Cagle’s phone as “best friend.”
In February 2015 Cagle was sent to the Texas Department of Criminal Justice as part of a plea bargain that included shock probation. After several months, Cagle was brought back to Bowie County and placed on a 10-year probation. As a condition of his probation, Cagle is required to permit searches of his car, home and person by law enforcement.
During a search April 29, officers allegedly discovered a Samsung Galaxy smart phone in Cagle’s car which contained sexually graphic images of young children. The phone was allegedly loaded with applications which make sharing photos simple.
Cagle is forbidden to possess a smart phone while a sex offender on probation in Bowie County.
A few days after the alleged discovery of the phone, probation officials in Bowie County filed a motion to revoke Cagle’s existing probation. Cagle’s newest case has not been formally indicted. Pesek scheduled Cagle to return to court Aug. 15. He remains in the Bowie County jail.
